Terms of Service

By downloading, installing, or using Kalamy (including the desktop application and web platform), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

1. Service Description

Kalamy is an AI-powered writing assistant available on macOS and Windows. It provides the following features:

  • Translate — Convert text into 14 languages using Google Translate
  • Improve — Fix grammar and clarity with AI assistance
  • Rephrase — Rewrite text in different tones (shorten, friendly, formal)
  • Explain — Generate plain-language summaries

Kalamy is triggered by double-copying text (⌘C ⌘C on macOS, Ctrl+C Ctrl+C on Windows) and displays results in a system-level popup.

2. Service Tiers

Free Tier

  • Unlimited translations (all 14 languages)
  • 14-day trial of AI features (Improve, Rephrase, Explain)
  • 10 AI actions per day during trial period
  • No account required
  • Free forever

Pro Tier

  • Everything in Free
  • 200 AI actions per day
  • Unlimited Improve, Rephrase, and Explain requests
  • Priority processing
  • $5/month or $50/year (discounted to save $10 annually)

Trial Period

The Free tier includes a 14-day trial of Pro features. The trial begins automatically on your first AI action. No credit card is required. After 14 days, you may either:

  • Continue using Free features (unlimited translation)
  • Subscribe to Pro for continued AI feature access

3. Subscription Terms

Recurring Billing

Pro subscriptions are recurring and will automatically renew at the end of each billing period (monthly or annually, depending on your chosen plan). You will be charged on the same day each month or year.

Payment

All payments are processed securely by Polar.sh. By subscribing, you authorize us to charge your payment method on file. Payment failures will prevent access to Pro features until resolved.

Cancellation

You may cancel your Pro subscription at any time from your account settings at kalamy.app. Cancellation takes effect at the end of your current billing period. No refunds will be issued for partial months or years.

Price Changes

We reserve the right to change subscription prices. Price increases will take effect at your next renewal date. We will notify you of significant price changes at least 30 days in advance.

4. Acceptable Use

You agree not to use Kalamy for any purpose that is unlawful or prohibited by these terms. Specifically, you will not:

  • Use the Service to process content that is illegal, defamatory, obscene, or otherwise harmful
  • Attempt to gain unauthorized access to Kalamy's systems, networks, or data
  • Reverse engineer, decompile, or disassemble the Kalamy application or API
  • Scrape, crawl, or automate access to the Service without prior written permission
  • Use the Service to create competing products or services
  • Transmit viruses, malware, or any harmful code through the Service
  • Use the Service to spam, harass, or infringe on others' intellectual property rights
  • Violate any applicable laws, regulations, or third-party rights

5. Intellectual Property

Kalamy and all of its content, features, functionality, and design are owned by Kalamy, its licensors, or other providers and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of any text you input into Kalamy. By using the Service, you grant Kalamy a limited license to process, store temporarily, and transmit your text to third-party APIs (Google Translate, AI service) solely to provide the requested features.

Generated translations and improvements remain your property. You are free to use, modify, and distribute them as you see fit.

6. Disclaimers of Warranties

AS-IS SERVICE

Kalamy is provided on an “AS-IS” and “AS-AVAILABLE” basis without warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to:

  • Implied warranties of merchantability or fitness for a particular purpose
  • Warranty that the Service will be uninterrupted, timely, secure, or error-free
  • Warranty that defects will be corrected
  • Warranty that the Service will be compatible with all systems or applications

THIRD-PARTY SERVICES

Kalamy relies on third-party services (Google Translate, AI APIs, Polar.sh). We are not responsible for:

  • Availability or performance of these services
  • Accuracy of translations or AI-generated content
  • Changes to or discontinuation of these services
  • Data practices of these third parties

You use these services at your own risk. Please review their terms and privacy policies.

AI-GENERATED CONTENT

AI-generated content (Improve, Rephrase, Explain) may contain inaccuracies, biases, or errors. You are responsible for reviewing and validating all AI-generated output before using it. Kalamy makes no warranty about the quality, accuracy, or appropriateness of AI-generated suggestions.

7. Limitation of Liability

DISCLAIMER OF DAMAGES

To the maximum extent permitted by law, Kalamy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

  • Your use of or inability to use the Service
  • Any inaccuracy or error in translations or AI-generated content
  • Loss of data, profits, business, or goodwill
  • Service interruptions or outages
  • Unauthorized access to your account or data

CAP ON LIABILITY

Kalamy's total liability for any claim shall not exceed the amount you paid for a Pro subscription (or $0 if you only used Free features) in the 12 months preceding the claim.

8. Indemnification

You agree to indemnify and hold harmless Kalamy, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms of Service
  • Your violation of applicable laws or regulations
  • Content you input or transmit through the Service

9. Termination

We may terminate or suspend your account and access to the Service immediately, without notice or liability, if:

  • You violate these Terms of Service
  • We reasonably believe you are using the Service unlawfully
  • Your payment fails (for Pro subscriptions)

Upon termination, your right to use the Service immediately ceases. Pro features will become inaccessible, but you may continue using Free features.

10. Modifications to Service

We reserve the right to modify, suspend, or discontinue the Service (or any feature) at any time, with or without notice. We are not liable for any loss or harm resulting from such modifications or discontinuance.

11. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the jurisdiction in which Kalamy operates, without regard to its conflict-of-law principles. Any disputes shall be resolved in the courts of that jurisdiction.

12. Severability

If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
